Dear Fellow Owners,
The default situation with Garth Enterprises has been cured pending the following. Pilot
Point has signed an assignment of the Garth contract to Apex Construction. Garth will act as the
only subcontractor of Apex. We are scheduled to close on the Mutual of Omaha loan on
Wednesday Oct. 19th. At the last minute, Mutual of Omaha has raised questions regarding our
master lease. Our legal counsel, with the help of the city, expects to satisfy the question but as
we have experienced repeatedly there is the risk of delay. Once we close on the financing Apex
has 72 hours to secure the bond. Once the bond is issued the default is cured. Unless there is
further delay construction and warranty work will recommence on approximately Oct. 27, 2016.
There is no additional cost to Pilot Point for the new contract arrangement. While the process and
agreement may appear arcane and convoluted our lawyers are comfortable with the agreements
and the Board has voted unanimously to approve them.
Garth has notified Pilot Point that they will recommence construction starting with buildings
3, 5 and 8, units 11-18, 26-32 and 47-53. Owners should take the necessary steps in preparing
their units as laid out at the annual meeting and repeated at the 8/27 special meeting. Videotaping
of the interior and exterior of each unit will occur prior to construction.
The Board encourages owners wishing to replace windows and doors (owner expense) to

For owners in buildings 4and 9 awaiting bills, now that we are continuing the construction
we will work out a time frame for Garth and the architect to answer questions on the billings.
